These Terms of Service apply to both the SafeCase website and the SafeCase mobile application.

By accessing, downloading or using SafeCase, you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree to these Terms, you must not use SafeCase.

Important Notice

SafeCase is an organisational tool only.

Nothing within SafeCase constitutes legal advice or creates a solicitor-client relationship.

SafeCase does not guarantee the admissibility of any evidence, documents, recordings or information stored within the platform.

About SafeCase

SafeCase is an Australian application designed to help individuals securely organise case information, evidence, communications, records and documentation.

SafeCase may be used for family law matters, domestic situations, workplace matters, school concerns, medical records, NDIS documentation, personal record keeping and other situations where structured documentation is important.

These Terms are governed by Australian law.

Eligibility

To use SafeCase, you must:

  • Be at least 18 years of age.
  • Be capable of entering into a legally binding agreement.
  • Use SafeCase only for lawful purposes and in accordance with these Terms.

By using SafeCase, you confirm that you meet these requirements.

Your Account

When creating a SafeCase account, you agree to:

  • Provide accurate and current information.
  • Maintain the confidentiality of your login credentials.
  • Keep your password secure.
  • Notify us immediately if you suspect unauthorised access to your account.
  • Accept responsibility for all activity that occurs under your account.

SafeCase is not responsible for any loss or damage arising from your failure to protect your account credentials.

Acceptable Use

You agree to use SafeCase only for its intended purpose.

You must not:

  • Use SafeCase for any unlawful, fraudulent or harmful purpose.
  • Upload content that is false, misleading, defamatory or infringes the rights of others.
  • Harass, threaten, intimidate or stalk another person through or in connection with SafeCase.
  • Interfere with the operation, security or performance of the platform.
  • Attempt to gain unauthorised access to any part of the platform or related systems.
  • Impersonate another person or entity.
  • Upload viruses, malware or other harmful software.

Violation of these Terms may result in suspension or termination of your account.

Your Content

You retain ownership of all content you upload to SafeCase, including:

  • Documents
  • Notes
  • Images
  • Audio recordings
  • Video recordings
  • Evidence files
  • Incident records
  • Case information

By uploading content to SafeCase, you grant us a limited, non-exclusive licence to store, process and display that content solely for the purpose of providing the service to you.

SafeCase does not claim ownership of your content and will not use your content for marketing purposes.

You are solely responsible for ensuring that your content complies with applicable laws and does not infringe the rights of any third party.

Audit Logging

SafeCase records a log of significant actions performed within your account.

These actions may include:

  • Login and logout activity.
  • Account creation and deactivation.
  • Profile updates.
  • Evidence creation, modification and deletion.
  • Evidence linked or unlinked from incidents.
  • Privacy setting changes.
  • Case exports generated.
  • Feedback and bug reports submitted.

Audit logs form part of the security and integrity of the service.

By using SafeCase, you consent to this logging.

Privacy

Your use of SafeCase is also governed by our Privacy Policy and Data Safety information.

By using SafeCase, you consent to the collection, storage and processing of information as described in those documents.

Intellectual Property

All intellectual property rights relating to SafeCase, including software, source code, design, branding, logos, graphics and website content, remain the exclusive property of SafeCase and its licensors.

You are granted a limited, non-transferable licence to use SafeCase for its intended purpose.

You must not copy, modify, sell, redistribute, reverse engineer or exploit any part of SafeCase without prior written permission.

Disclaimer of Warranties

SafeCase is provided on an "as is" and "as available" basis.

To the maximum extent permitted by Australian law, SafeCase makes no warranties, representations or guarantees regarding the reliability, accuracy, availability, suitability or performance of the service.

While reasonable steps are taken to maintain security and availability, we do not guarantee uninterrupted or error-free operation.

Limitation of Liability

To the maximum extent permitted by law, SafeCase and its developers will not be liable for any indirect, incidental, consequential or special loss arising from:

  • Use of the service.
  • Inability to use the service.
  • Loss of data.
  • Loss of evidence.
  • Loss of documents.
  • System outages.
  • Unauthorised access beyond our reasonable control.

Nothing in these Terms excludes rights that cannot legally be excluded under the Australian Consumer Law.

Account Termination

You may stop using SafeCase and request deletion of your account at any time.

Upon deletion, your account and associated data will be scheduled for removal in accordance with our Privacy Policy.

SafeCase reserves the right to suspend or terminate access where:

  • These Terms are breached.
  • Unlawful activity is suspected.
  • Required by law.
  • Necessary to protect the security or integrity of the platform.

Changes to These Terms

We may update these Terms of Service from time to time.

When changes are made, the "Last Updated" date at the top of this page will be revised.

Your continued use of SafeCase after changes are published constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of Australia.

Any dispute arising out of or relating to these Terms or the use of SafeCase will be subject to the jurisdiction of the Australian courts.
