By downloading or using SafeCase, you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree, do not use SafeCase.

Nothing in this app constitutes legal advice or creates a solicitor-client relationship. Please consult a qualified Australian legal professional for advice specific to your situation.

1. About SafeCase

SafeCase is an Australian application designed to help individuals involved in family law matters, domestic situations, and related legal proceedings to securely manage case evidence, communications, journal entries, incidents, and documentation.

SafeCase is an organisational tool only. It does not provide legal, financial, medical, counselling, crisis, or emergency services.

These Terms are governed by the laws of Australia. Any disputes are subject to the jurisdiction of Australian courts.

2. Eligibility

To use SafeCase, you must:

  • Be at least 16 years of age.
  • If you are under 18 years of age, review these Terms and the Privacy Policy with a parent, guardian, or other responsible adult where appropriate.
  • Meet the minimum age requirement applicable in your jurisdiction.
  • Be capable of entering into a legally binding agreement, or have appropriate authority or support to use the app.
  • Use the app only for lawful purposes and in accordance with these Terms.

SafeCase is not directed to children under the age of 16 and is not intended to be used by young children.

3. Your Account

When you create a SafeCase account, you agree to:

  • Provide accurate information during registration, including your name and email address.
  • Keep your login credentials — including your password and any PIN — confidential.
  • Notify us immediately at [email protected] if you suspect unauthorised access.
  • Accept responsibility for all activity that occurs under your account.
  • Maintain independent backups of important information, files, evidence, journal entries, incidents, and case material.

SafeCase is not liable for any loss or damage arising from your failure to keep your credentials secure or your failure to maintain independent backups of important material.

4. Free Plan & Premium Subscription

SafeCase offers a Free Plan and a paid Premium subscription. The Free Plan is designed to let users create a basic case record while keeping safety features accessible.

Free Plan

The Free Plan currently includes 1 active case, up to 20 file upload records, up to 5 journal entries, up to 3 incidents, and access to safety features including PIN lock, Incognito Mode and Quick Exit. Exports are not included in the Free Plan.

For the purpose of plan limits, a file upload record means one saved file upload entry in SafeCase. A single file upload record may contain one or more attached files, depending on how the entry is created in the app.

SafeCase Premium may include:

  • Unlimited active cases.
  • Unlimited file upload records.
  • Unlimited journal entries.
  • Unlimited incidents.
  • PDF, Excel and audit exports.
  • Future premium features introduced by SafeCase.
  • Premium subscriptions are billed through the Apple App Store (iOS), Google Play (Android), or another authorised payment provider.
  • Subscriptions automatically renew unless cancelled before the renewal date.
  • Plan limits, features and prices may change over time. Where required, changes will be handled in accordance with the relevant app store rules and applicable consumer law.

How to cancel

To cancel your subscription, go to your device's App Store or Google Play subscription settings and cancel SafeCase before the next renewal date. Cancellation stops future charges; your Premium access continues until the end of the current billing period.

SafeCase does not offer refunds for partial months or unused subscription periods, except where required by Australian Consumer Law or by the relevant app store/payment provider. All displayed prices are in the currency shown at the point of purchase and include taxes where applicable.

5. Acceptable Use

You agree to use SafeCase only for its intended purpose. You must not:

  • Use the app for any unlawful, fraudulent, abusive, exploitative, or harmful purpose.
  • Upload content that is false, misleading, defamatory, unlawful, or that infringes any third-party rights.
  • Use SafeCase to harass, threaten, stalk, intimidate, monitor, coerce, or control any person.
  • Upload material that you are not legally permitted to collect, store, possess, or use.
  • Interfere with or disrupt the integrity or performance of the app or its infrastructure.
  • Attempt to gain unauthorised access to any part of the app, its servers, or related systems.
  • Impersonate any person or entity.
  • Upload or transmit malicious code, viruses, or harmful software.

Violation of these rules may result in immediate suspension or termination of your account without notice.

6. Your Content

You retain ownership of all content you upload, create, or store in SafeCase, including case notes, journal entries, incident records, documents, photos, audio, video, and other files ("Your Content").

By uploading or creating content, you grant SafeCase a limited, non-exclusive licence to store, process, display, organise, and export Your Content solely for the purpose of providing the service to you. We do not claim ownership of Your Content and will not use it for advertising or unrelated purposes.

You are solely responsible for ensuring that Your Content does not violate any applicable law or third-party rights. SafeCase does not review, verify, endorse, or guarantee the accuracy, legality, authenticity, completeness, or admissibility of any content uploaded or created by users.

7. File Storage & Types

SafeCase accepts common file types — including documents, photos, videos, audio recordings, PDFs, spreadsheets, and other file formats supported by the app. Your ability to create cases, add file upload records, create journal entries, record incidents or export material may be subject to technical, storage, security, or subscription limits.

Files are stored securely in Google Firebase Storage (Google Cloud) and are accessible only to your authenticated account through the app. SafeCase does not sell, rent, or trade your uploaded files.

8. Audit Logging

SafeCase automatically records a log of significant actions taken within your account — including logins, evidence uploads, journal entry creation, incident creation, profile changes, and privacy setting changes. These logs are stored securely within your personal account data and are accessible only to you through the app.

By using SafeCase, you consent to this logging as it forms part of the security and integrity of the service.

10. Privacy

Your use of SafeCase is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using SafeCase, you consent to the collection and use of your information as described in the Privacy Policy.

11. Intellectual Property

All intellectual property rights in SafeCase — including the app's design, code, content, layout, features, and branding — remain the exclusive property of SafeCase and its owner/developers. You are granted a limited, non-transferable licence to use the app for its intended purpose.

You must not copy, modify, distribute, sell, resell, lease, sublicense, or reverse engineer any part of SafeCase without our prior written consent.

12. Disclaimer of Warranties

SafeCase is provided on an "as is" and "as available" basis. To the maximum extent permitted by Australian law, we make no warranties — express or implied — regarding the app's reliability, accuracy, availability, fitness for a particular purpose, or suitability for any legal proceeding. We do not warrant that the app will be free from errors, interruptions, delays, data loss, security incidents, or technical problems, although we take reasonable steps to maintain its security and availability.

13. Limitation of Liability

To the maximum extent permitted by law, SafeCase and its owner, developers, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive loss or damage arising from your use of — or inability to use — the app, including loss of data, case information, evidence, revenue, opportunity, reputation, or legal outcome.

To the maximum extent permitted by law, SafeCase's total aggregate liability arising out of or relating to the use of the service will not exceed the amount paid by you to SafeCase during the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies that cannot be excluded under the Australian Consumer Law.

14. Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold harmless SafeCase, its owner, developers, employees, contractors, and service providers from and against any claim, liability, loss, damage, cost, or expense arising out of or in connection with:

  • Your use or misuse of SafeCase.
  • Your uploaded or created content.
  • Your breach of these Terms.
  • Your breach of any law, regulation, court order, or third-party right.
  • Any reliance placed on material stored, organised, exported, or created through SafeCase.

15. Service Changes

SafeCase may update, modify, suspend, limit, or discontinue any part of the app or its features at any time. Where practical, we will try to provide reasonable notice of material changes. Some changes may be required without notice for security, legal, technical, operational, or compliance reasons.

16. Termination

You may stop using SafeCase and deactivate or delete your account at any time through the Settings screen. Upon deletion, your account and all associated data will be permanently deleted, subject to any limited retention required for legal, security, dispute resolution, or compliance purposes.

Deleting your SafeCase account does not automatically cancel any active subscription purchased through the Apple App Store, Google Play, or another authorised payment provider. Subscriptions must be cancelled separately through the relevant provider.

If you cancel your subscription, your access to premium features continues until the end of the current billing period, after which your account will revert to Free Plan access or limited access unless otherwise stated in the app.

SafeCase reserves the right to suspend, restrict, or terminate your access at any time, with or without notice, if we reasonably believe you have breached these Terms, created a safety or security risk, misused the app, or if suspension or termination is required by law.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we update the "Last updated" date at the top of this page. Your continued use of SafeCase after changes are published constitutes acceptance of the updated Terms.

18. Governing Law

These Terms are governed by the laws of Australia. Any dispute arising from or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Australia.
